Services Warranty
This warranty is for services provided by Mod Restoration ("Mod") that the purchaser paid Mod to do. Services include reupholstery, refinishing, caning or custom drapery. It does not include vintage furniture or fabric purchases.
Mod warrants to you, the original purchaser, that for the stated warranty term, Mod will repair any piece of furniture which is defective in workmanship*, within the stated timeframe, as described below. To exercise your rights under this warranty, you must submit the original sales receipt when making a claim.
The "warranty period" begins when the product is delivered. If you notice a manufacturing defect, it is important for you to promptly notify Mod.
After notification of a claim, it may be necessary for Mod to arrange for an inspection of your furniture to determine whether or not a manufacturing defect exists. These are your exclusive remedies under Mod's warranty.
Warranty Terms & Coverage
Workmanship
All residential workmanship* is warranted for 1 year, and commercial workmanship is warranted for 3 months (see footnote regarding COM material).
Cushion Cores
Depending on the manufacturer, cushion cores may not be warrantied. Subsequently, Mod will extend to the customer the manufacturer's warranty (if applicable). The manufacturer's warranty typically covers the cushion core against loss of resiliency for a certain period of time (e.g. 6 months). Loss of resiliency does not include any slight softening of a cushion or the flattening of the fiber top.
Fabric
The fabric manufacturers typically do not warranty any of their fabrics. Selecting fabric is solely at the discretion of the client, and Mod is not responsible for any fabric defects. In the event of a defect, Mod will assist in helping our clients submit a claim to the fabric manufacturer. However, the client is responsible to cover any associated costs to reupholster the furniture.
Shipping
The original purchaser must arrange for shipping/delivering of the product to us for repair/replacement. Any shipping/delivery charges are to be paid for by the original purchaser.
Limitations and Exclusions
The following things will limit or exclude coverage under this warranty.
Implied Warranties
Mod makes no implied warranties on merchantability or fitness for a particular purpose. These and all other implied warranties are specifically disclaimed. By "implied warranties" Mod means warranties that the law sometimes implies to have been given by the seller even though they are not set out in writing.
Household Use
This warranty applies only when you reupholstered your furniture with Mod for your own normal indoor household use (including use as a gift to another for household purposes) and not for resale or commercial use, which includes rental, business, and institutional or other non-residential use.
Improper Care and Use
Your furniture requires some routine maintenance. Please take care to treat your furniture like the fine product it is. Proper care and use are essential to preserving your rights under this warranty. Mod will not repair or replace your furniture if improper maintenance or improper use causes damage. This warranty does not apply if your Mod product is damaged by the use of detergents, abrasives or other harsh cleaning agents.
Accidents, Abuse and Normal Wear and Tear
This warranty does not cover damage resulting from negligence, abuse, normal wear and tear, or accidents: including burns, cuts, scratches, tears, scuffs, watermarks, indentations or pet damage. Breakage or damage occurred during a local or long distance move is not covered under our warranty.
Product Modification
Any product modification by dealer, consumer, or other parties not authorized by Mod will void this warranty.
Consequential or Incidental Damages
Mod will not be liable for consequential or incidental damages. By this Mod means any loss, expense, or damage other than to the furniture itself that may result from a defect in the furniture.
*In all cases where the customer has provided their own materials (C.O.M.), the warranty on workmanship will be evaluated at time of claim. If a Mod representative determines that the cause for the claim was due to integrity breakdown of the client's own material (fabric or leather), the warranty will be voided.
